STALLION SERVICE CONTRACT
This agreement is by and between Joy and Mark Dunton at Painted Sky Ranch,
hereinafter referred to as Stallion Owner and/or Manager and
___________________________, hereinafter referred to as Mare Owner. Stallion
Owner hereby agrees to breed the Paint Horse Stallion, What If Hez An Angel,
APHA registration #670,867, to the mare, ______________________________________,
BREED _____________
REGISTRATION NO. ______________,
SIRE ________________________, DAM ___________________________, which is owned
or leased by Mare Owner during the breeding season of _________.
Mare Owner
hereby agrees to pay the following fees for service pursuant to this agreement:
A non
refundable boarding fee of $8.00/dry and $10.00/wet shall be charged to Mare
Owner by Stallion Owner for each day afore stated mare (and foal) are at Painted
Sky Ranch.
Non
refundable veterinary and farrier fees shall be charged to Mare Owner by
Stallion Manager for appropriate services for afore stated mare (and Foal). Said
fees shall be paid before mare and (foal) leave Painted Sky Ranch.
A
booking fee of $125.00 of the $450.00 stud fee is payable with this contract and
the balance of $325.00, plus all unpaid expenses will be payable upon the afore
stated mare leaving Painted Sky Ranch. The booking fee is nonrefundable.
Breeding Condition of Mare: Mare Owner agrees that Mare is in sound breeding
condition, free from infectious, contagious, and/or transmittable diseases.
Mares must be wormed within 60 days, and vaccinated within 6 months of their
arrival at Painted Sky Ranch. Out of State Mares must have a negative Coggins
Test prior to arrival. It is highly recommended that ALL MARES have a uterine
culture done on their heat cycle immediately preceding their arrival. Mare Owner
authorizes Stallion Owner to obtain said uterine culture, breeding soundness
exam, and/or vaccinations if not previously done, at Mare Owner’s expense.
Pregnancy Check: Mare Owner agrees to have the Mare examined by an early
ultrasound scan between 14 and 18 days from the last day of insemination and
notify Stallion Owner of her pregnancy status. It is suggested that Mare stay at
Painted Sky Ranch until checked in foal.
Live Foal
Guarantee: Live Foal guarantee means the foal shall stand and nurse. It is
understood that if the mare proves barren, aborts, or if a foal is still born, a
return season will be guaranteed the following year only, providing proper
notification is given. Proper notification shall be defined as follows; written
certification by a licensed veterinarian within seven days of the mare slipping
subsequent to the mare’s departure from Painted Sky Ranch. Booster
rhinopneumonitis vaccinations must be administered as indicated by the
individual drug manufacturer, (5th, 7th and 9th
Month), as the mare progresses through her pregnancy. Failure to do this will
void the live foal guarantee.
Mare Owner
hereby agrees that Stallion Owner reserves the right to refuse service to any
mare which appears to be unfit for breeding, in the opinion of the Stallion
Owner.
It is
agreed by the parties hereto that if the afore stated stallion should die, be
sold or become unfit for breeding before serving afore stated mare, or if afore
stated mare should die, be sold or become unfit for breeding before served, this
agreement is and shall be null and void, except for provision in paragraphs 1
and 2.
Waiver of liability. Mare Owner understands that the Stallion Owner, it’s
employees and guests shall not be held liable for any claim resulting from
injury, escape, disability or death of afore stated mare (and foal). The Mare
Owner will not be responsible for any damage, injury or death to the breeding
farms stallion, employees and guests. Should afore stated mare (and foal) become
missing, lost, strayed, seriously injured, sick or dead, Stallion Owner hereby
agrees to notify Mare Owner or his authorized agent immediately by telephone.
Stallion
Owner hereby agrees to maintain afore stated mare (and foal) in good condition
pursuant to this agreement, with proper care, handling and protection, according
to the rules of good animal husbandry and reasonable standards and practices of
the horse industry.
A breeder’s
certificate for the registration of the foal resulting from the breeding, will
be issued to Mare Owner after all expenses have been paid in full and upon
notification of birth of the foal.
Stallion Owner hereby agrees that Mare Owner may go upon Stallion Owner’s
premises at any time and inspect afore stated mare (and foal) and determine if
same is in good health and being properly care for.
This agreement and all
covenants and agreements herein contained shall accrue to and be binding upon
the parties hereto, their heirs, successors, administrators, and executors. Upon
material breach of this agreement by one party may terminate same.
No
modification of this agreement shall be binding unless in writing and executed
by the parties hereto.
This
agreement is subject to the laws of the state of California, executed on
